In the Fraud Act 2006, the Crown Prosecution Service describes that a fraud crime (criminal activity for monetary gain) can be carried out in three different ways. This includes fraud by false representation, fraud by failure to disclose information where it is legally necessary to do so and fraud by abuse of position. These actions are used to carry out different types of fraud crimes. If these actions are carried out dishonestly, for financial gain or to cause loss to another, there may be a maximum sentence of up to 10 years of imprisonment whether or not the gain or loss occurs.
