The Environment Agency is the prosecution agency responsible for investigating and prosecuting suspects in respect of a wide range of offences including;
- illegal waste disposal (fly-tipping)
- landfill control & waste breaches contrary to Environmental Protection Act 1990 (Section 33), and Environmental Permitting (England and Wales) Regulations 2010 (regulations 12 and 38(1), (2) and (3).

The Environment Agency are also increasingly applying to the Court for Restraint Orders and are pursuing Confiscation Proceedings under the Proceeds of Crime Act 2002. They can also ask the Court to impose Ancillary Orders including the Forfeiture of a Vehicle, Deprivation of Property and in some cases Remediation.
